Conversion to tenant ownership

When the tenants of a building form a tenant-owner association and buy the building, the rented flats become tenant-owned. The law sets requirements on the majority, the plan and an inspection.

The decision

The association decides to buy at a general meeting. The decision is valid if the tenants of at least two thirds of the let flats concerned agree. They must be members and, for homes, have been registered as living at the property for at least six months before the meeting (Tenant-Owner Act, chapter 9, section 19, Act 2026:480).

Before the decision an economic plan must be drawn up and made available to the tenants, with an inspection report on the building's condition and two certificates (section 20).

The tenants' right of first offer

Through an association the tenants can register an interest with Lantmäteriet, noted in the land register, if the tenants of at least two thirds of the let flats have declared their interest in writing (Conversion Act, section 3). If the property has at least three flats (section 2), the owner may then not sell without first offering the building to the association (section 6). The registration runs for about two years (section 5).

From the law

«Beslutet är giltigt om hyresgästerna i minst två tredjedelar av de uthyrda lägenheter som omfattas av förvärvet har gått med på beslutet.»

Those who do not buy

A tenant who does not want to buy stays on as the association's tenant, with the Tenancy Act's protection.
